Caves and Brownfields

Caves
Under Tennessee Code Annotated § 11-5-108, it is an offense for any person, without the prior permission of the owner, to knowingly:

  1. Deface or destroy natural formations within a cave, such as stalactites, stalagmites, and flowstone;
  2. Harm or disturb any plant, animal, or artifact found therein;
  3. Alter the natural condition of the cave; or
  4. Tamper with, remove, or disturb a lock, gate, door, or other structure designed to prevent entrance to the cave, whether or not entrance is actually gained.

Violations of this statute are considered offenses under Tennessee law.

Brownfields
Tennessee's brownfield redevelopment program is established under T.C.A. § 68-212-224, which creates a voluntary cleanup oversight and assistance program. This program allows the commissioner of the Department of Environment and Conservation to enter into voluntary agreements or consent orders for the investigation and remediation of brownfield sites with willing participants. The program also offers liability protection under certain conditions. 

Additionally, T.C.A. § 68-212-226 authorizes the use of tax increment financing by local governments for brownfield projects, facilitating their redevelopment.
