Child Support

Courts may order the assignment of an employee’s income, including a municipal employee’s income, for child support or spousal support. Employers are prohibited from retaliating against an employee, including by disciplining or discharging the employee, because the employee’s income is subject to an assignment for child or spousal support under Tennessee and federal law. Assignment of income by a court for child support or spousal support must be made in accordance with Title 36, Chapter 5 of the Tennessee Code. If an employer fails to comply with an income‑assignment order, a judgment may be entered against the employer in the same manner as set forth in Title 26, Chapter 2, Part 2.
