Expungement in municipal courts: an MTAS guide

This is a publication produced by MTAS which explains expungement in municipal courts. Topics covered are expungements in traditional municipal courts and municipal courts with concurrent general sessions jurisdiction, relevants state laws, expungement and traffic citations, and how to manage expunged records.

Additionally MTAS has created three sample documents for municipal courts who will expunge eligible municipal offenses under T.C.A. § 16-18-302(a)(3): a sample ordinance regarding municipal court expungement and fees; a petition for the expungement of municipal court record; and an order for the expungement of municipal court record.

Incompatible municipal offices and employment

The question of whether a municipal official can simultaneously hold another governmental office arises frequently. Similarly, questions often arise regarding whether an individual can simultaneously hold a municipal office and another position of employment. Several sources of law must be considered when these types of questions arise: the Tennessee Constitution, statutes, charter provisions, municipal code provisions, ethics provisions, personnel regulations, the common-law prohibition against an individual serving in incompatible offices, and the common-law conflict-of-interest principle.
