MTAS was asked three questions from the city of Clinton regarding the power of the City Judge. Can the Clinton City Judge:

1.  issue inspection (search) warrants for code enforcement action?
2. issue court order(s) with specific time limits to remediate code violations? We know judge can issue fines; we’re looking for code enforcement orders based on adopted city ordinances.
3. issue arrest warrants for repeat violators?

MTAS was asked for a legal opinion regarding the following question: "If the City receives a certificate of compliance application that is otherwise satisfactory in all regards, must the City grant a liquor license up to 10 such licenses?"

MTAS Legal Consultant Elisha Hodge responded to a request for information regarding whether or not a city has the authority to charge privilege tax to private clubs in relation to liquor by the drink.
