TOWN OF WOODBURY

AN ORDINANCE AMENDING TITLE 16, SECTION 109 OF THE WOODBURY MUNICIPAL CODE
WHEREAS, Section 4 of the Town’s Charter authorizes the town to regulate the establishment, construction, and maintenance of sidewalks and to require adjoining property owners to construct and maintain sidewalks and to pay for such construction and maintenance; and
WHEREAS, Title 16, Section 109 of the Woodbury Municipal Code requires abutting occupants to maintain sidewalks; and
WHEREAS, it is generally recognized today that sidewalks are legally a part of city streets, and in most cities, the construction and maintenance of streets is a city responsibility, including sidewalks; and
WHEREAS, it is also easier for the town to maintain uniformity in appearance and construction and maintenance standards, if the town constructs and maintains sidewalks; and
NOW, THEREFORE, BE IT ORDAINED by the Board of Mayor and Aldermen of the Town of Woodbury, Tennessee:
Section 1. The Town of Woodbury Municipal Code is hereby amended by deleting Section 16-109 in its entirety.
Section 2. This ordinance shall become effective upon final passage, the public welfare requiring it.
