The Federal Communications Commission issued its opinion that the City of Troy, Michigan violated Section 621(b)(3)(B) of the Communications Act of 1934, as amended by the Telecommunications Act of 1996, by refusing to grant construction permits to petitioner without agreeement that no telecommunications services would be provided using the petitioner's facilities until all necessary permits were obtained, including a telecommunications franchise from the city.
