A resolution requiring the retirement of police officers who are members of TCRS and have reached the age of 62.
CITY OF SMITHVILLE, TENNESSEE
RESOLUTION NO.________
WHEREAS, Tennessee Code Annotated , Section 8-36-205 (a) (2 ) authorizes cities to establish a mandatory retirement age for members who are employed as firefighters or police officers with a political subdivision participating in the Tennessee Consolidated Retirement System, or who have been transferred from such a position to a supervisory or administrative position within the police or fire department; and
WHEREAS, the above code section authorizes cities to establish mandatory retirement for police officers who have attained the age of sixty (60); and
WHEREAS, the City of Smithville desires that its police officers be retired at agesixty-two ( 62) ; and
NOW, THEREFORE, BE IT RESOLVED by the Board of Mayor and Aldermen of the City of Smithville, Tennessee, that all of the city’s police officers who are members of the Tennessee Consolidated Retirement System and who have attained the age of sixty-two(62) years of age are required to retire; and
BE IT FURTHER RESOLVED that this resolution shall become effective sixty (60) days after final passage.
