A RESOLUTION CONCERNING THE PROPOSED SALE OF THE CABLE TELEVISION SERVICE OPERATED BY THE BOARD OF PUBLIC UTILITIES, AND PROVIDING FOR A REFERENDUM OF THE VOTERS TO APPROVE SUCH SALE
WHEREAS, the Town of Covington Board of Public Utilities currently operates a cable television service, offered through the municipal electric plant operations, pursuant to the authority granted by Tennessee Code Annotated § 7-52-601, et seq.; and
WHEREAS, the cable services offered by the Town of Covington, and the infrastructure relating to such cable television service is more particularly described as follows: (insert a full description of the property to be sold); and
WHEREAS, the Board of Mayor and Aldermen has determined that it is not economically feasible for the Town to continue to offer such services, and has further determined that it would be in the best interests of the Town and its citizens to sell said cable service and the related infrastructure for the delivery of cable services; and
WHEREAS, the Town has received an offer from ________________ to purchase the cable service and relating infrastructure for the amount of ________________ (specify the terms and conditions, if payment will not be made in cash); and
WHEREAS, the Board of Mayor and Aldermen has approved of the proposed sale; and
WHEREAS, state law, at Tennessee Code Annotated §§ 7-52-601 and 7-52-132, requires that such sale be approved at referendum by a majority of voters participating in the election.
NOW, THEREFORE, BE IT RESOLVED by the Board of Mayor and Aldermen of the Town of Covington, Tennessee:
Section 1. That the Board of Mayor and Aldermen of the Town of Covington hereby approves of the proposed sale of the cable service to ________________, for the amount of ____________________.
Section 2. That the City Recorder submit this Resolution to the Tipton County Election Commission with a request that an election be called in the Town of Covington and the following question be placed on the ballot:
Shall the Town of Covington sell the cable service to ____________ for the amount of ______________ ?
For the sale _______________
Against the sale _________________
Section 3. That an election be held on ________________________, 2007, between the hours of ______ and ______, at the following polling sites: (fill in with addresses of voting locations).
Section 4. That the election shall be advertised in a newspaper of general circulation for four consecutive weeks prior to the election date. Said advertisement or notice shall state the purpose of the election, describe the proposed sale which is the subject of the referendum, and further state the date and time of the election, as well as the locations at which votes may be cast.
