AN ORDINANCE TO AMEND TITLE 14
OF THE CITY OF LOUDON MUNICIPAL CODE
REGARDING THE CREATION AND MEMBERSHIP
OF THE MUNICIPAL PLANNING COMMISSION
WHEREAS, municipal planning commissions are regulated under state statutes found in title 13, Chapter 4 Part 1 of the Tennessee Code Annotated; and
WHEREAS, Tennessee Code Annotated § 13-4-101 authorizes cities to have municipal planning commissions with up to ten members; and
WHEREAS, Tennessee Code Annotated § 13-3-102 authorizes municipal planning commissions to serve as regional planning commissions; and
WHEREAS, Section 14-103 of the Loudon municipal code book states that the municipal planning commission has been designated a regional planning commission; and
WHEREAS, the City of Loudon desires to amend the City of Loudon’s municipal code to increase the membership of the planning commission from nine to ten and to designate that one member of the planning commission be a non-citizen of the city.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LOUDON, TENNESSEE that:
SECTION 1. The City of Loudon municipal code is amended to increase the membership of the planning commission from nine to ten and to specify that one member must be a non-resident of the city. The first two sentences of Section 14-101 are hereby repealed and replaced with the following:
14-101. Creation and membership. Pursuant to the provisions of section 13-4-101 of the Tennessee Code Annotated there is hereby created a municipal planning commission, hereinafter referred to as the planning commission. The planning commission shall consist of ten (10) members; two of these shall be the mayor and another member of the governing body selected by the governing body; one member shall be a non-resident of the city appointed by the mayor; and the other seven (7) members shall be appointed by the mayor.
SECTION 2. Severability clause. If any section, phrase, sentence or portion of this ordinance is held invalid or unconstitutional for any reason by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision; and such holding shall not affect the validity of remaining portions thereof.
SECTION 3. Effective Date. This ordinance shall be effective upon final passage unless by its terms the effective date is deferred.
