ORDINANCE 06-01



AN ORDINANCE OF THE CITY OF CLINTON, TENNESSEE AMENDING TITLE 11, CHAPTER 2 PERTAINING TO ALCOHOL.


WHEREAS, Article III, Section 1 of the Clinton City Charter grants the city general powers to enact ordinances;

WHEREAS, Article III, Section1 (t) authorizes the city to license and regulate all persons, firms, corporations, companies and associations engaged in any business, occupation, calling, profession, or trade not forbidden by law; and

WHEREAS, Article III, Section 1 (w) empowers the city to prescribe limits within business occupations or practices liable to be nuisances or detrimental to the health, morals, security or general welfare of the people may lawfully be established, conducted or maintained; and

WHEREAS, Article III, Section 1 (bb) authorizes the city to enforce ordinance 06-01 by means of fines, forfeiture, or by action or proceedings in any court of competent jurisdiction or by any one (1) or more of such means and to impose cost as a part therefore, but no fine, forfeiture, or penalty shall exceed an amount determined by the City Council, not to exceed the state limits; and

WHEREAS, subsequent to the above passages, the Clinton City Council desires to make it mandatory to provide photo identification when any person of legal age purchase alcoholic beverages within the corporate limits of Clinton.

BE IT ORDAINED BY THE CITY OF CLINTON AS FOLLOWS


Section 11-203: Any person attempting to purchase an alcoholic beverage or beer is required to furnish to the seller of the beverage a current photo identification evidencing the person’s birth date.

Section 11-204: Any permittee or other person who sells, furnishes, disposes of, or causes to be sold, furnished, or disposed of any alcoholic beverage to any person regardless of that person’s apparent age, shall require that person to provide photographic identification evidencing that person’s age prior to each purchase.

Section 11-205: Any establishment within the corporate limits of Clinton, Tennessee which sells alcoholic beverages or beer shall prominently display on the premises front door and at the point of display of merchandise signage not less than six inches (6") high and ten inches (10") wide which states AA minor who attempts to purchase alcoholic beverages shall be prosecuted to the fullest extent of the law for violation of Tennessee Code Annotated 57-4-203.
Section 11-206: Date of effect. This ordinance shall take effect from and after its final passage, the public welfare requiring it, and the municipal code including all the codes and ordinances therein adopted by reference, shall be effective on and after that date.
