CITY OF SMITHVILLE, TENNESSEE
ORDINANCE NO.____
AN ORDINANCE ABANDONING PART OF A CITY STREET IN SMITHVILLE
WHEREAS, Walnut Street is a street in the commercial district of the City of Smithville, and the owner or developer of a business on the south side of Walnut has proposed a new business that would require that part of the street and sidewalk be closed in favor of a drive through; and
NOW, THEREFORE, BE IT ORDAINED by the Board of Mayor and Aldermen:
Section 1. The City of Smithville hereby abandons eleven feet of street right of way on the South side of Walnut Street beginning at 4th Street and extending for a distance of 62.23 feet in a westerly direction.
Section 2. The City of Smithville will not make further claims to ownership or use.
Section 3. This ordinance shall become effective upon final passage, the public welfare requiring it.
