Re: Frequency of Election-Local Option

Dear Mr. Hurst

TCA 57-3-106, (f)(2) provides that not more than one election for local option in any municipality shall be held within any period of twenty-four (24) months. Subsection (3) provides that should any municipality conduct a local option election in conjunction with any general election, and the number of qualified votes cast negative to the local option proposition exceeds sixty percent (60%) of the total number of votes cast in the election, no further local option election in such municipality shall be held for a period of four (4) years from the date of such previous election.

Please call me if you need further clarification.

Sincerely

Ron Darden
