ORDINANCE NO. ___________


AN ORDINANCE TO CHANGE THE TOWN ELECTION DATE
TO THE NOVEMBER GENERAL ELECTION DATE.


WHEREAS, at present, the Board of Mayor and Aldermen of New Tazewell, Tennessee, serve four year staggered terms with three aldermen up for election every four years; the remaining three aldermen up for election two years later; and the mayor up for election every four years with his current term up for election on December 11, 2010; and

WHEREAS, the election date is currently the second Saturday in December and elected officials take office at the first regularly scheduled meeting after the election results are certified; and

WHEREAS, the Board of Mayor and Aldermen of the Town of New Tazewell wish to change the election of the mayor and aldermen so that elections are held on the November general election date, which is the Tuesday after the first Monday in even-numbered years; and

WHEREAS, pursuant to section 6-3-104 of the charter for the Town of New Tazewell, election dates may be changed, however, the new election date shall not become effective until after the next election following the adoption of this ordinance; and

WHEREAS, pursuant to section 6-3-104 of the charter for the Town of New Tazewell, aldermanic and mayoral terms may be extended to meet the new election date, but no term may be extended for more than two years beyond its regular expiration date.


NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF MAYOR AND ALDERMEN OF THE TOWN OF NEW TAZEWELL, TENNESSEE THAT:


SECTION 1. The terms of the three aldermen elected in December 2008 shall be extended from the second Saturday in December 2012 until the certified candidates, elected on the Tuesday after the first Monday in November 2014, are sworn into office. This will result in an increase of approximately twenty three months in the terms of the aldermen elected in December 2008. Thereafter, elections will be held for these seats for a four year term beginning with the elections held in November 2014.

SECTION 2. The terms of office of the mayor and three aldermen elected in December 2010 shall be extended from the second Saturday in December 2014 until the certified candidates, elected on the Tuesday after the first Monday in November 2016, are sworn into office. This will result in an increase of approximately twenty three months in the terms of the aldermen elected in December 2010. Thereafter, elections will be held for these seats for a four year term beginning with the elections held in November 2016.

SECTION 3. This ordinance shall take effect immediately upon final passage, the public welfare requiring it.
