Text of Document: The Model Stormwater Ordinance, as written, is not a stand-alone document. No Stormwater Best Management Practices (BMP’s) are incorporated in the body of the ordinance. Rather, the Model Ordinance adopts BMP Manuals by reference The Model Ordinance will not be complete without the adoption by reference of these BMP manuals. The only other alternative would be to write BMP’s into the body of the Model Ordinance, which MTAS does not recommend. The ordinance was entirely rewritten with the goal of compliance with the 2010 permits. The ordinance is a model; it is intended to be adapted for the local government’s specific requirements. While the permits require pollution reduction and permanent measures to capture 100% of the first inch of any event, the model ordinance goes beyond this. Quantity and rate of flow issues for events above one inch with which local governments historically must deal are also addressed. The appendices are not intended for adoption; they include relevant information and model documents.

Please remember that this ordinance was drafted based upon the drafting requirements and authority granted to a particular city or town in its charter and in general law. These drafting requirements and the authority exercised in this ordinance might not apply to your city or town.

Please confer with your city attorney or an MTAS legal consultant, or both, before using this ordinance as a model.
