An Ordinance Regulating the Use of Chicken Manure as a Yard or Field Fertilizer within the City
Whereas, the use of chicken manure for yard or field fertilizer produces a very offensive odor, now therefore,
Be It Ordained by the Board of Commissioners of the City of Collinwood, Tennessee as follows:
Section 1. Definition. Chicken manure shall mean excreted waste from chickens, which may include any mixture of wood shavings, saw dust or other wood or organic materials that are removed from commercial chicken houses or chicken growing houses or facilities.
Section 2. The use of or placement of chicken manure in any form within 500 feet of any platted subdivision lots, residential or commercial structures within the city is hereby prohibited unless it is covered with four (4) inches of soil within two (2) hours of its placement.
Section 3. A notice shall be published in the local newspaper stating that it is illegal to use chicken manure within 500 feet of platted subdivisions, lots, residential or commercial structures within the city, unless such chicken manure is covered with four (4) inches of soil within two (2) hours of placement.
Section 4. Violators of this ordinance shall be subject to a $50 per day fine, each day of violation being a separate violation. Violators will receive a citation to municipal court, and may face other legal action by the City to enforce compliance.
Section 5. It shall be the duty of any police officer or the building official to enforce the provisions of this ordinance.
Section 6. This ordinance shall become effective immediately upon its passage and upon the publication of the above notice in the local newspaper, the public welfare requiring it.
