ORDINANCE NO. _____________ AN ORDINANCE OF THE TOWN OF MONTEREY, TENNESSEE, PROHIBITING HEAVY TRUCK TRAFFIC ON CROSSVILLE STREET DURING SCHOOL DAYS FROM 7:30 A.M. TO 8:30 A.M. AND 2:30 P.M. TO 3:30 P.M.
WHEREAS, heavy trucks may cause safety concerns when traveling on certain streets such as Crossville Street, and;
WHEREAS, the regulation of such vehicles is necessary in order to protect the investment in infrastructure and property made by the City and safety of school children, and;
WHEREAS, alternative routes exist for heavy traffic during school days and thus the use of Crossville Street is not necessary from the times described above:
Be It Ordained by the Board of Mayor and Aldermen of the Town of Monterey, Tennessee as follows:
NOW, THEREFORE BE IT ORDAINED by the Town of Monterey, Tennessee that,
Section 1. It shall be unlawful for any person to operate upon Crossville Street any freight motor vehicle, tractor-trailer, or semi-trailer with a gross rated weight of more than 24,000 pounds during school days from 7:30 a.m. to 8:30 a.m and 2:30 p.m. to 3:30 p.m.
Section 2, Exceptions to this ordinance include the following:
Construction-related vehicles in the performance of temporary activities.
Trucks owned or operated by the City, the County, other governmental entities, or any utility in the conduct of official business.
Any such truck under contract with the City, County, other governmental entity, or utility in the occasional conduct of official business.
Section 3. Any person who violates any provision of this ordinance shall be subject to a fine of up to $50 per occurrence.
Section 4. This ordinance shall become effective upon its final passage, the public welfare requiring it.
