An Ordinance to Change the City Election Date to the November General Election Date
Whereas, the Town’s of Iron City’s present election date is the last Tuesday in May of even numbered years; and
Whereas, the Town of Iron City desires to change the Town election date to coincide with the November General Election date, the first Tuesday following the first Monday of November of even numbered years; and
Whereas, TCA 6-20-101 (c)(2)(A) provides that if a term expires six (6) months or less before a regular November election, the board of commissioners may by a two-thirds (2/3) vote of the board of commissioner membership by ordinance extend the length of the terms of an incumbent to coincide with the next regular November General election; and
Whereas, the terms of office of the present board of commissioners will expire in less than six (6) months or less before the regular November election; now therefore
Be It Ordained by the Town of Iron City:
Section A. Board of Commission members elected in May of 2006, whose terms expire in May of 2010, shall have their terms of office extended until the first Tuesday after the first Monday in November, 2010 to coincide with the November General Election date.
Section B. Board of Commission members elected in May of 2008, whose terms expire in May of 2012, shall have their terms of office extended until the first Tuesday after the first Monday in November, 2012 to coincide with the November General Election date.
Section C. After the terms of office are extended, the terms of office for board of commission members shall be for four (4) years.
Section D. A two-thirds (2/3) vote of the membership of the board of commissioners shall be required for passage of this ordinance.
Section E. A copy of this ordinance shall be provided to the Lawrence County Election Commission and a copy shall be published in a newspaper of general circulation.
Section F. This ordinance shall be effective upon its passage, the public welfare requiring it.
