A resolution requesting Senator Roy Herron and Representative John Tidwell sponsor legislation before the General Assembly that amends Chapter 365 of Private Acts of 1923; Chapter 499 of Private Acts of 1925; Chapter 567 of Private Acts of 1931; Chapters 403 and 404 of Private Acts of 1945; Chapters 551 and 680 of Private Acts of 1947; Chapters 551 and 561 of Private Acts of 1951; Chapter 366 of Private Acts of 1953; Chapter 99 of Private Acts of 1981; and Chapter 153 of Private Acts of 2000, and any other acts amendatory thereto, relative to elections in the Town of Linden.


WHEREAS, The Town of Linden was incorporated under Chapter 365 of the Private Acts of 1923; and

WHEREAS, The Town of Linden desires to change its election date to save the expense of holding its own election; and

WHEREAS, The Town of Linden desires to have its election coincide with the regular county primary elections in May.


BE IT RESOLVED BY THE BOARD OF MAYOR AND ALDERMEN OF THE TOWN OF LINDEN that the Board of Mayor and Aldermen requests that Senator Roy Herron and Representative John Tidwell sponsor legislation before the General Assembly that makes the following revisions to the Linden Charter:

Section 1. Chapter 365 of Private Acts of 1923; Chapter 499 of Private Acts of 1925; Chapter 567 of Private Acts of 1931; Chapters 403 and 404 of Private Acts of 1945; Chapters 551 and 680 of Private Acts of 1947; Chapters 551 and 561 of Private Acts of 1951; Chapter 366 of Private Acts of 1953; Chapter 99 of Private Acts of 1981; and Chapter 153 of Private Acts of 2000, and any other acts amendatory thereto is amended in Section 5 by replacing the word “January” with “June.”

Section 2. Chapter 365 of Private Acts of 1923; Chapter 499 of Private Acts of 1925; Chapter 567 of Private Acts of 1931; Chapters 403 and 404 of Private Acts of 1945; Chapters 551 and 680 of Private Acts of 1947; Chapters 551 and 561 of Private Acts of 1951; Chapter 366 of Private Acts of 1953; Chapter 99 of Private Acts of 1981; and Chapter 153 of Private Acts of 2000, and any other acts amendatory thereto is amended in Section 32 by repealing the section in its entirety and replacing it with the following:

Sec. 32. Be it further enacted, the three Aldermen elected in December of 2003 shall have their terms extended until their successors are duly elected and qualified during the county primary election held on the first Tuesday of May 2008. Furthermore, the three Aldermen and the Mayor elected in December of 2005 shall have their terms extended until their successors are duly elected and qualified during the county primary election held on the first Tuesday of May 2010. Thereafter, all regular city elections will be held in conjunction with the county primary election, held on the first Tuesday of May in even numbered years. Terms of office are staggered and are for a period of four years or until the elected official’s successor has been duly elected and qualified. Should there be a tie, the Board of Mayor and Aldermen shall decide the election by a majority vote.
