AN ORDINANCE TO AMEND SECTION 2-111
OF THE MUNICIPAL CODE OF LINDEN, TENNESSEE,
PERTAINING TO THE LOCATION RESTRICTION
OF STORES SELLING ALCOHOLIC BEVERAGES AT RETAIL

WHEREAS, pursuant to Tennessee Code Annotated , Section 57-3-208(c), municipalities are authorized to limit the location of retail liquor stores and the number of licenses issued within their jurisdictions; and

WHEREAS, pursuant to Tennessee Code Annotated , Section 57-3-208(c), no local law, ordinance or resolution may limit the location and number of licenses authorized under 57-3-204, so as to unreasonably restrict the availability of alcoholic beverages for the residents of such municipalities and counties; and

WHEREAS, the existing 500 foot distance requirement is unreasonably restrictive; and

WHEREAS, the Board of Mayor and Aldermen of the Town of Linden desires to make the distance restriction more reasonable.


BE IT ENACTED BY THE BOARD OF MAYOR AND ALDERMEN OF LINDEN, TENNESSEE:

Section 1. The words “five (500) hundred feet” in Section 2-111, subsection (1) of the Linden code book shall be replaced with “three hundred (300) feet.”


THAT THIS ORDINANCE SHALL TAKE EFFECT FROM AND AFTER ITS PASSAGE, THE PUBLIC WELFARE REQUIRING IT.
