AN ORDINANCE TO CHANGE THE CITY ELECTION DATE TO THE NOVEMBER GENERAL ELECTION DATE AND CONTINUE TO PROVIDE FOR 4 YEAR STAGGERED TERMS FOR THE BOARD OF COMMISSIONERS
WHEREAS, at present, the commissioners of the City of Collinwood, Tennessee, serve four year staggered terms with two commissioners up for re-election on odd numbered years, and the remaining two commissioners and the mayor up for re-election the following odd-numbered year; and
WHEREAS, the mayor currently serves a four year term; and
WHEREAS, the election date is currently the fourth Saturday in June; and
WHEREAS, the Board of Commissioners of the City of Collinwood wish to change the election of the mayor and commissioners so that elections are held on the November general election date, which is the Tuesday after the first Monday in even-numbered years; and
WHEREAS, state law allows for the extension of the terms of the mayor and commissioners of the commission necessary to meet the new election date, but no term may be extended for more than two years beyond its regular expiration date; and
WHEREAS, Tennessee Code Annotated (TCA) 6-20-102 allows commissioners to extend the terms of office for up to twenty-four (24) months by ordinance for the purpose of changing the election date to coincide with the November General election; now
THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS CITY OF COLLINWOOD, TENNESSEE AS FOLLOWS:
Section 1.
(A) The terms of office of the two commissioners elected in June 2007, shall be extended from the fourth Saturday in June, 2011 until Tuesday after the first Monday in November, 2012. This will result in an increase of approximately seventeen (17) months in the terms of the commissioners elected in June 2007.
(B) The terms of office of the two commissioners elected in June 2009, shall be extended from the fourth Saturday in June 2013 until Tuesday after the first Monday in November, 2014. This will result in an increase of approximately seventeen (17) months in the terms of office of the aldermen and the mayor elected in June 2009.
(C) The term of office of the mayor elected in June 2009, shall be extended from the fourth Saturday in June, 2013 until Tuesday after the first Monday in November 2014. This will result in an increase of approximately seventeen (17) months in the term of the mayor elected in June 2009.
Section 2.
The commissioners and the mayor to be elected in the November general elections and every four years thereafter, shall be elected for a four year term of office.
Section 3. Upon final passage of this ordinance, a copy shall be forwarded to the Wayne County Election Commission.
Section 4. This ordinance shall take effect immediately upon final passage, the public welfare requiring it.
