AN ORDINANCE OF THE CITY OF GALLAWAY, ESTABLISHING A DRIVER EDUCATION COURSE AND PROVIDING FOR ITS OPERATION.

WHEREAS, the Commission has determined that it is in the best interest of the City of Gallaway to provide the city judge with additional options when adjudicating traffic law violations; and

WHEREAS, Tennessee Code Annotated (T.C.A.) 55-10-307 enables the City to adopt by reference the provisions of 55-10-301, which allows the court to require persons violating certain traffic laws to attend a driver education course approved by the Tennessee Department of Safety.

NOW, THEREFORE BE IT ORDAINED BY THE CITY OF GALLAWAY, TENNESSEE, as follows:

Section 1. That the terms and provisions as set forth in Tennessee Code Annotated 55-10-301 and all amendments thereof, are hereby adopted and ratified as though copied verbatim herein, together with all future amendments of this state law are made a part hereof by reference.

Section 2. That the Police Department, under the supervision of the city judge, is hereby authorized and directed to operate and conduct a driver education or improvement course.

Section 3. That a reasonable fee between fifty dollars ($50.00) and seventy ($70.00) shall be assessed for the driver education course to each person who attends, however, no one shall be refused admittance for inability to pay.

Section 4. That all ordinances and parts of ordinances, which are inconsistent with the provisions of this ordinance, are hereby repealed to the extent of such inconsistency.

Section 5. That this ordinance shall take effect fifteen (15) days from and after its first passage, or upon final passage, whichever is later, the public welfare requiring it. Nor shall this ordinance take effect until it is published as required by law.
